If that is War Machine, then why doesn't he look black and white, it just looks kinda like the Iron Man suit Red n Yellow....

red and yellow maybe the reflections of his gun firing. looks like they did the warmachine concept art that was was released together with concept arts of ironman for the first film.

Okay I couldn't do much with the pic it was just to dark, but im looking at it now and it doesn't look like War Machine. It looks like some Killzone type SWAT team guy, He has a P90 machine gun rifle in his hand, also looks like he has SWAT shoulder pads and a large SWAT/ARMY helmet on. Maybe this is a SHIELD agent using stolen tech from Tony.

i was there and can say it looks exactly like the concept above, except the chest piece/eyes are red, and the mini gun is on the opposite shoulder, and it larger

In all fairness, after the fact, the WM pic does look red and gold/yellow, but it's probably due to the gunfire; w/ it blown up it DEFINITELY looks like WM, esp. w/ the bulk of the suit.

That last pic you posted of the toy, That is War machine only with Iron Man colors to no doubt throw us off. If you look at it, he looks just like the War Machine pics above that Tea Bag posted.
