Fox Wins Back Watchmen Rights! Judge Rules Against Warner Bros!

It's a very Merry Christmas for 20th Century Fox, who now has a federal judge on its side in the copyright case they filed against Warner Bros.

“Fox owns a copyright interest consisting of, at the very least, the right to distribute the ‘Watchmen’ motion picture,” the ruling said.

LOS ANGELES — In a surprise ruling, a federal judge in Los Angeles said he intended to grant 20th Century Fox’s claim that it owns a copyright interest in the “Watchmen,” a movie shot by Warner Brothers and Legendary Pictures and set for release in March.

The decision was disclosed in a five-page written order issued on Wednesday. Gary A. Feess, a judge in the United States District Court for Central California, said he would provide a more detailed order soon.

Fox has been seeking to prevent Warner from releasing the film. The superhero adventure, based on the “Watchmen” graphic novel, is being directed by Zack Snyder (who also directed “300”) and has shaped up as one of most eagerly anticipated releases for next year.

A Warner spokesman, Scott Rowe, declined to comment on the ruling and the studio’s plans.

At an earlier hearing, the judge said he believed that issues in the case could be settled only at a trial, which was scheduled for late January. On Wednesday, however, Judge Feess said he had reconsidered and concluded that Fox should prevail on crucial issues.

“Fox owns a copyright interest consisting of, at the very least, the right to distribute the ‘Watchmen’ motion picture,” the ruling said.

Fox acquired rights to the “Watchmen” graphic novel in the late 1980s for the producer Lawrence Gordon, but eventually dropped its own plan to make a movie from its story, about the underside of life for superbeings.

Mr. Gordon later pursued the project with Universal Pictures, and then with Paramount Pictures, before shooting it with Warner and Legendary under an arrangement that allows Paramount to distribute the film abroad.

In ruling on Wednesday, Judge Feess advised both Fox and Warner to look toward a settlement or an appeal.

“The parties may wish to turn their efforts from preparing for trial to negotiating a resolution of this dispute or positioning the case for review,” he said.

so fox shits the bed by dropping the movie and then when someone else takes the responsiblity and gives people what they want with what will certainly be a successful movie, fox has to be shit heads and take credit for all the work. Fox did nothing for this movie and I think this is bullshit

Well, all depending what's really on Fox's minds, it may still come out. If Warner conseeds the rights to putting out the "west" Batman Tv series, they might settle.

I agree, this is complete crap, but guys (and girls) please don't take it out on Wolverine. The director, writer, producers and actors spent a lot of time and money making what looks to be a great film, and screwing them over just to get back at Fox is a bad idea.

With Punisher doing bad, and now apparently the spirit following suit, a third strike in the form of a poorly recieved Wolverine might kill off this comic book movie renaissance(sic). Even though I may not like all the adaptations being made, Im glad that someone is even giving them notice, and I'd hate to see the studios cut projects such as Captain America or Green Lantern or whatever because of this current drought of successful comic book films.

And besides, even if you do boycott Fox films, its not really going to hurt the greedy big wigs. These fatcats are going to get paid either way, and pretty much a bad film will mean they get a porsche instead of a lamborgini. Then, they will shrug their shoulders and move on to the next big craze (which appears to be remaking 80's and 90's action films). Worst of all, they will blame us for not seeing their movies, not their own greed and imcompetence. Meanwhile, the studio personal, the writers and the people who make these comicbook films will get screwed. I dont think anyone wants that.

People said I was stupid for boycotting FOX movies. But whose laughing now? ......well not me. This sucks!

There are already enough comic movies in the works. So even if Wolverine flops, theres still more coming out regardless. If they do good, then they will make more. Its not like there gonna see that three did bad in a row and then shut down production on the rest of them. But if theres a slew of flops, then we have to be worried.

lol, this is just too funny. Next thing they'll start talking about the watchmen curse, every time they tried making more money off it, it just bit them in the ass.

Guess those NY tickets really are going to be collector's items.

If enough people don't see Wolverine they'll just think it floped, if you want the message to come across, you'd need lots of people not just boycotting Wolverine but boycotting ALL Fox movies (if possible all fox products), and letting the media know the reason for the boycott, all over the US. Then maybe just maybe they'd fire those slimy greedy bastards. Everyone here knows that I'm no fan of Snyder's Watchmen, but this corporate version of the cold war really is [frick]ed up.

Still have to agree with Hyson, this is caused by a squidless watchmen script. That sudden change of heart by the juror has to be caused by a squid or millions of dollars.

Any victory you achieve by sacrificing your own men is a hollow victory... but a victory nontheless. Even though I'm not the biggest Watchmen fan, I hate this scenerio on principle, as it is a blantant example of greed coming between comicbook fans and the work they love. If they had done this with Batman or X-Men, I imagine I would be going bezerk as well. As such I understand the fury you all must be feeling.

Here's an idea that might have been kicked around before; start an online petition (or a written one or whatever you like) stating that every person who signs it will NEVER see ANY of Fox's films, or if your feeling a little extra zealous all of their products and productions as well, as long as Watchmen is not released in theaters. Given the intensity we see here on the boards I can see you guys getting hundreds, maybe thousands of signitures on this. For each day the movie is delayed beyond its release date, refuse to see Fox films until it is finally released. Although Fox doesnt want to admit it, they are counting on you folks to see their superhero movies, so thousands of lost customers will equal millions of lost dollars. Be steadfast in your commitment, and if they call your bluff, they will see their profit margins dwindle more by the day. Then, they will take you seriously and, hopefully, they will release the movie.

The main idea, though, is to get them to see, in writing, the massive amount of lost customers and thus prevent the movie from being delayed before the delays begin. And of course, people like me dont have to worry about seeing Wolverine being boycotted :)

( Merry Christmas Watchmen fans, you’re screwed. The ongoing legal battle between Warner Bros. and Fox over the rights to the already finished Watchmen film was supposed to be settled after the New Year, but out of nowhere (on New Year’s Eve no less) a Federal Judge decided to settle the whole thing by handing the rights to the movie over to Fox. That’s right, Fox. You remember Fox? They’re the studio whose lawyers, back in August when this whole thing started heating up, said their only goal was to keep the film from being released. Fox has made it clear they aren’t in it for the money, only to keep you from seeing Watchmen.

It looks like Fox now has the legal power to make that happen. According to the NY Times the court’s ruling says, “Fox owns a copyright interest consisting of, at the very least, the right to distribute the ‘Watchmen’ motion picture.” One would presume that also gives them the right not to distribute it. Though the Times story suggests that Fox could end up as a profit participant, it seems Fox indeed still maintains that it isn’t interested in money and only wants to keep the movie from being released.

After sending Watchmen into a black hole the judge did suggest that both parties look for a settlement to find some resolution. There’s also room here for an appeal by Warner Bros. I know everyone (except Fox) has been adamant all along that the movie will be released on schedule, but come on this has to at least delay it some doesn’t it? Who watches the Watchmen? Maybe nobody.)

I think that Snyder, or whoever has the final copy should bootleg that mother f*cker! I know how much Hollywood hates piracy, but if Fox is planning on saying, "no way are we releasing this film they made without our permission", and if it's really not about the money and they wanna destroy that sh*t, well then whoever has the final cut right now should just say f*ck it, and give it out for free! A final f*ck you to Fox! Bootleg it with an intro saying this was the movie they trid to stop, and if the movie is as hot as it looks, mother f*ckers will be egging Fox Studios, aqnd many many people will get fired over there, and have to suck d*ck for quarters! E-Z!

WB is just plain stupid, for making a movie to which they have not secured copyright. However Fox is just plain evil, waiting for the movie to be in production/post-production to mess around with the release, it's not like they didn't know WB was making the movie before that.

My goodness! Such vitriol over a movie. And, so intelligently articulated, too! What are you people, . . . twelve? I like a good comic book movie as much as anyone, but let's have some perspective here. Frankly, I am just tickled that Fox won this legal case. After all of the adaptations that Warners screwed up, from The Avengers to Wild Wild West, I am perfectly pleased to see someone - anyone - stick it to them a little bit.
