Was phase 2 hinted in the Avengers?

There was a scene in the Avengers that may have given something away, and im not sure if it's been pointed out

First off, I know this editorial isn't going to be great. Judge me or delete it if you want.

I recently watched the Avengers and there was a scene in the very beginning that I feel like may be overlooked. When Nick fury goes in front of the "counsel", it is mentioned that Phase 2 isn't ready and that they are forced to go into the Avengers initiative.

Most people think that Tony will create Ultron, but what if it is this counsel and shield that creates him. What if he's been being built this whole time?

With the first trailer for Winter Soldier out today, it's obvious that shield can't be trusted and want to "take care of threats before they happen". All signs point to this being the plan all along

they also describe phase 2 as the building of weapons from the Tesseract. i don't think Ultron was hinted in the 1st Avengers. The only person who can have anything to do with creating Ultron is Tony since there hasn't been any Pym sightings. The only contracts the government has that could lead to an AI for use is Hammer industries, but his stuff was all garbage and he is in prison.

Im pretty sure they said Pym wouldn't have anything to do with Ultron.

Not to mention the Original Human Torch was seen in Cap TFA, which alludes to the fact that AI was created long before Pym.

I wrote something a while ago basically saying what you said, though I didn't think of the Counsel creating him. I could definitely see that happening. They use the tesseract to power their own Iron Man type armor, as they've never been fans of the Avengers.

i thought phase two was that thing about them storing hydra weapons & keeping them secret from the avengers.

Stark made JARVIS and his his mk 42 used AI. Ultron is AI because his intelligence came from an outside force. He is sentient, yes, doesn't mean he isn't AI.

Phase 2 was simply creating weapons from the tesseract. Forming the Avengers was Fury's alternative to such a plan. It's spelled out pretty well in the few scenes "phase 2" is mentioned.

How about rogue elements within the World Security Council and SHIELD are responsible. Maybe they steal technology from Stark, Pym, AIM and others to develop the AI supersoldier that they think they can control. Too soon I guess.
