As part of New York's Adult Survivors Act, Spider-Man: No Way Home star Jamie Foxx has found himself facing serious allegations of sexual assault for an incident which is said to have taken place in 2015.

Variety reports that Spider-Man: No Way Home star Jamie Foxx was sued yesterday, Wednesday, November 22, for allegedly sexually assaulting a woman at a rooftop bar in 2015. 

The lawsuit for the alleged incident was filed in New York by a woman identified only as "Jane Doe." She claims to have been seated with a friend next to Foxx and the bar's owner Mark Birnbaum. At 1 am, Doe's friend got up and asked Foxx for a photo, to which he supposedly agreed. 

A seemingly intoxicated Foxx is said to have then begun complementing the plaintiff, making remarks like "Wow, you have that supermodel body" and "You smell so good," while comparing her to Gabrielle Union. She goes on to allege that the actor took her by the arm and led her to a secluded part of the rooftop where he proceeded to grope her breasts and reportedly forced his hands down her pants and "put his fingers on and in Plaintiff’s vagina and anus."

It's also alleged that a security guard witnessed the incident but did not intervene. When the woman's friend came and found her, Foxx stopped and walked away. 

The lawsuit was filed under New York's Adult Survivors Act. It opened a one-year window for people to file sexual assault claims that would otherwise be barred by the statute of limitations, with the deadline to file any such claims ending today. 

Birnbaum and the bar, Catch NYC, are also named as defendants for allegedly enabling the assault and failing to properly supervise their employees. However, the main target is obviously Foxx, who is being sued for pain, suffering, emotional distress, anxiety, and humiliation. The woman claims to have sought medical help as a result of the incident which is described as "sexual assault, abuse, assault and battery."

Foxx's reps haven't issued any sort of response and it's unclear how valid these claims are. 

For context, Diddy, Cuba Gooding Jr., Axl Rose, Harvey Weinstein, Donald Trump, Bill Cosby, Marcellus Wiley, Jimmy Iovine, Doug Morris, LA Reid, Russell Brand, Marilyn Manson, and Harve Pierre are among those who have had lawsuits filed against them under New York's Adult Survivors Act.

This year, Foxx has starred in God Is a Bullet, They Cloned Tyrone, Strays, and The Burial. After returning as Electro in 2021's Spider-Man: No Way Home, it was later rumoured that the actor would return as Max Dillon in a solo project. However, that's failed to ever materialise.

@eddyxx - No. This allegedly happened in 2015. So they waited a LOT longer than his sickness and recovery.

@UniqNo - I sort of get it but statute of limitations are in my mind dumb, can take years for victims to come to terms enough to talk about this sort of stuff let alone come forward to the athorities with it and abusers should not be able to get away with their activities knowing chances of charges brought extremely low...

...as I say I sort of get the other side of the argument esp if entirely a he said she said but...

@Apophis71 - I hear that, and it must be difficult for these people who were truly wrong to find the courage to come forward....i just hope they got the evidence to back themselves up, otherwise they're opening themselves up to alot of scrutiny.

@lazlodaytona - Not just Hollywood (and certainly not all by far even if it can feel like it) but there is a reason for the saying power corrupts...

...perception of power and belief you can thus do anything, add drink and drugs into the mix and...

...that said likely still a minority who are bad but as we notice the bad, the bad more reported more than the good, perceptions of reality easily warped.

That and even the best of us can make mistakes in the wrong combo of circumstances so when your easily recognisable with the press all over your every move and all that...

@LysergicMeinbal - I completely agree. I'm not sexist or anything but during my divorce a few years back, my ex-wife falsely accused me of domestic violence. I've never even had a parking ticket before but all the cops fed into her crap because she was this petite, little pretty thing.
I had to spend a week in the county jail, lost my job because of it, simply because she "cried wolf."

Women always say they want to be equal to men but they take EVERY advantage of being a woman when compared to men. I am not a woman hater by any means, but the certain crazy ones get away with too much crap.

It doesn't say she said no, protested or was too drunk to consent. It just says she got finger banged by a movie star on a roof. So now that didnt lead to a career boost and the bragging rights are stale shes going the other way? If this is one of those I couldn't say no because hes so famous and a big man and i'm a little girl, so weak and mild, then jog right on. What is with criminalising people trying to get it on?! Bs.
